Terms of Use - Founders Beta Cohort

1. Agreement

This Founding Beta Cohort Agreement (the "Agreement") is between Disco Innovation Studio Ltd., operating as Delivered by Design ("we", "us") and the organization named in the Order Details below ("Organization"). It covers the Organization's participation in the one-time Founding Beta Cohort (the "Beta") of the course Applied Design Strategy for Product Leaders (the "Course").

The Course Terms of Use and Copyright Notice apply to the Beta except where this Agreement says otherwise. If the two conflict, this Agreement controls for the Beta.

2. Order Details

3. What the Organization Receives

  • Access to all five Course modules: Module 1 delivered live in the first session, Modules 2, 3 and 4 completed self-paced between the two live sessions, and Module 5 delivered live in the closing session.

  • Two live facilitated sessions with Lena Stachiw, delivered virtually to the combined cohort: an opening session (Module 1) and a closing session (Module 5), each 90 minutes. Sessions focus on discussion and applying the method to participants' own delivery work.

  • The Leader Workbook (templates and frameworks).

  • One 1:1 check-in of up to 30 minutes per organization, held in the middle week between the two live sessions (the week of January 25, 2027). After signing, the Organization receives a link to our online scheduling page to book a time, or can ask us to arrange it later. Bookings close on January 22, 2027; after that date we will propose a time.

  • Captions, transcripts and accessible PDFs at no extra cost. Accommodation requests are never an upcharge.

The Course is training, not consulting. It does not create a client, advisory or professional services relationship.

4. One-Time Founding Benefit

The live sessions, the 1:1 check-in and the discounted founding rate are a one-time founding benefit for Beta organizations only. They are not part of the Course as offered after launch and are not available for renewal or extension. Nothing in this Agreement commits us to offer live components in future.

5. Beta Access Period

Founding Beta participants receive 12 months of access to the finished self-paced Course. The 12-month period begins on the date the complete Course is made available to the public (the "Release Date"), not on the date of purchase.

Until the Release Date, participants have access to the modules and live sessions as described in Section 6.

6. Cohort Format

  • The Beta runs as one combined cohort with participants from up to three organizations. We aim to keep the total cohort to about 30 participants, including add-on seats.

  • The Beta is deliberately short to limit the time participants commit. It starts on January 19, 2027. The Beta runs three weeks, from January 19 to February 9, 2027.

  • The format has two live sessions and three self-paced modules. The opening live session delivers Module 1. Modules 2, 3 and 4 are self-paced between the sessions. The closing live session delivers Module 5 and closes out the Beta.

  • Live session dates: the opening session is on Tuesday, January 19, 2027, and the closing session is on Tuesday, February 9, 2027, both planned for 10:30am to 12:00pm Pacific / 12:30 to 2:00pm Eastern.

  • Each session has two parts: a short teaching segment led by us, and a discussion and application segment with participants.

  • We may reschedule a session with at least 5 business days' notice. If we cancel a live session outright, we will reschedule it or provide a recording of the teaching segment.

7. Recording and Consent

  • We record live sessions. Discussion and application segments are recorded for cohort-internal use only (for example, for participants who miss a session) and are never published or used in the public Course.

  • Teaching segments will be re-recorded without participants for the public Course. Participants' voices, images, questions and names will not appear in public Course materials.

  • Each participant must give written consent to recording before the first session. We will provide a consent form.

  • Participants must not record the sessions themselves.

  • Cohort-internal recordings are deleted within 12 months of the Release Date.

8. Confidentiality and Ground Rules

Because participants come from different organizations, including government and regulated sectors:

  • Participants will not share internal specifics about their employer, clients, colleagues, or other participants' organizations outside the session.

  • Participants will not attribute comments made in the cohort to a named person or organization outside the cohort.

  • Participants should avoid sharing information that is protected, personal, privileged or otherwise restricted by their employer's policies. Each Organization is responsible for confirming that its participants may take part.

  • Anything too sensitive for the group can be raised in the 1:1 check-in.

  • We will treat any information an Organization shares with us in the 1:1 check-in or feedback as confidential and will not disclose it, except as set out in Section 9.

  • We may remove a participant who breaches these ground rules, without refund for that seat.

9. What We Ask in Return

Because the Beta is discounted, each Organization agrees to:

  • Structured feedback on every module, using a short form we provide. Feedback on Modules 1 to 4 is due by February 5, 2027. Feedback on Module 5 is due by Februrary 15, 2027.

  • Before-and-after outcome data: a short baseline survey at the start, a brief survey at the close, and a follow-up survey 60 days after the closing session, so we can show outcomes. We will share the aggregated results with the Organization.

  • A written case study, developed with the Organization's input and approval.

  • A testimonial, if the Organization is satisfied with the Course.

Publication permissions. We will not publish any testimonial, case study, name, title or organization name without the Organization's written approval of the final text. Data in case studies may be anonymized and aggregated at the Organization's request.

Providing feedback, data, a case study or a testimonial is a condition of the founding rate.

10. Intellectual Property

  • We own the Course Materials, including everything delivered in live sessions. Sections 3, 5 and 6 of the Terms of Use and Part B of the Copyright Notice apply to Beta participants.

  • The Organization may use the templates, canvases and frameworks inside its own organization for internal purposes, as the Terms describe.

  • The Organization owns its own data and the outcomes of its own work.

  • Feedback and testimonials are licensed to us as described in Part B, Section 10 of the Terms.

11. Seats and Participants

  • Each seat is for one named person. Seats cannot be shared or transferred without our written consent.

  • The Organization provides participant names and work emails before the Beta start date.

  • Replacing a participant before the opening live session is free. After that, please ask us.

  • The buyer and the learners may be different people. The Organization is responsible for its participants' compliance with this Agreement.

12. Payment, Taxes and Refunds

  • Prices are in Canadian dollars.

  • Payment is due at time of registration.

  • Refunds. Full refund up to 30 days before the Beta start date; no refund after the first module is delivered, except as set out in Section 5 or Section 13.

  • Add-on seats are charged at $687 each and are subject to the same terms.

13. Changes, Cancellation and Minimum Cohort Size

  • The Beta runs only if at least 2 organizations enrol by January 12, 2027. If it does not run, we refund all fees paid in full.

  • We may adjust module order, content and scheduling to improve the Course. We will make reasonable efforts to deliver the core promised content.

  • If we are unable to complete the Beta for reasons within our control, we will refund the portion of the fee for undelivered modules, calculated by modules remaining.

14. Accessibility

We aim to meet WCAG 2.2 AA standards for Course materials and live sessions. If a participant encounters a barrier, contact hello@deliveredbydesign.co. We will respond within 5 business days and work with the participant on an alternative format.

15. Privacy

We collect and use participants' names, work emails, feedback, survey responses and booking details (such as the time chosen for the 1:1 check-in) to deliver the Beta and improve the Course, as described in our Privacy Policy. We handle personal information in accordance with applicable Canadian privacy law.

16. Disclaimer and Limitation of Liability

  • The Beta provides general education. It is not legal, financial or other regulated professional advice.

  • We make no promise of any specific result, including improved ROI, budgets or project outcomes.

  • The Beta is an early version of the Course and may contain gaps or errors that we will work to correct.

  • To the fullest extent permitted by law, our total liability for any claim relating to the Beta is limited to the amount the Organization paid. Nothing here excludes liability that cannot be excluded by law.

17. Termination

We may suspend or end a participant's or Organization's access without refund for breach of this Agreement or the Terms of Use, including sharing accounts, breaching confidentiality ground rules, or redistributing materials. The Organization may withdraw at any time, subject to Section 12.

18. Governing Law and Disputes

This Agreement is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there. The parties will first try to resolve disputes informally. If unresolved after 30 days, disputes will be decided by the courts of British Columbia.

19. General

  • Entire agreement. This Agreement, the Terms of Use and the Copyright Notice are the whole agreement for the Beta.

  • Severability, no waiver, assignment. As set out in Section 18 of the Terms of Use.

  • Changes. Changes to this Agreement must be in writing and signed by both parties.
